MyMenopauseRx, LLC (“MyMenopauseRx,” “we,” “us,” or “our”) recognizes the importance of protecting your privacy and personal information. Protecting your Personal Identifiable Information(PII) and your Protected Health Information(PHI) is our priority.
As such, we have prepared this Privacy Policy to provide you with important information about the our practices applicable to mymenopauserx.com (the “Site”), which is a Telehealth platform that provides access to consultation services and lab testing, collectively referred to as "Services" related to menopause through secure telehealth technology. The Site consists of various web pages operated by MyMenopauseRx, LLC. ("MyMenopauseRx").
Individuals who choose to access and use the Website (hereinafter “you” or “User” and collectively the “Users”) consent to the data practices described in this Policy as well as our Terms and Conditions (“Terms”). Definitions used in our Terms have been adopted in this Privacy Policy.
Collecting your health data helps us to provide you with a personalized online health experience. You may browse the Site and/or many of our applications without providing any Personally Identifiable Information (PII) or Protected Health Information (PHI). However, we ask that you provide information at various times and locations through the Site.
When you sign up or create an account with MyMenopauseRx, we ask you to confirm that you have read, acknowledged, understood and agreed to our Privacy Policy. This means that by submitting your Personally Identifiable Information (PII) or Protected Health Information (PHI) and other information to our Site, you consent to the collection, use, and disclosure of such information as set forth in this Privacy Policy.
We collect your name and email address when signing up or creating an account for our Site. Additional personal identifiable information such as, but not limited to: your age, address, phone number, payment information, etc. is collected when ordering lab testing or scheduling a menopause consultation.
Any medical or health information (PHI) that you provide that is subject to specific protections under applicable state laws will be used and disclosed only in accordance with such applicable laws. However, any information that is not protected under such applicable state laws may be used or disclosed in any manner permitted under our Privacy Policy.
Our online doctors office and lab testing services are designed for use by women 40 years of age and older. If you are younger than age 40, please do not provide any information to us through the Site. We do not knowingly collect personally identifiable information from individuals under 18. If we learn we have collected any PII and or PHI from an individual under the age of 18, we will delete the information.
We use and disclose your Personally Identifiable Information (PII) to make payments, to run our healthcare operations and send you emails. We use and disclose your Protected Health Information (PHI) to provide you with medical care, to run our healthcare operations and to comply with regulations. We implement a range of technical, administrative and physical safeguards to protect both your PII and your PHI. We use your email address to send you different types of emails, including but not limited to: emails that update the status of your care by an alert that a secure message is waiting for you in your patient dashboard on the MyMenopauseRx Site , emails when lab testing results are available on your patient dashboard, emails asking for feedback on your experience of using the service, marketing emails to notify you of services we provide, or emails if you create an account but do not complete a visit with one of our certified clinicians. We will share your email and name with third party email platforms to enable us to send aforementioned emails.
We also use your Personally Identifiable Information (PII) for payment for services you request offered by MyMenopauseRx. We share your PII and credit card details with Square, our online payment processor and they store them on our behalf. We share your Protected Health Information (PHI) with selected organizations that provide us with services to provide your treatment and to run our healthcare operations. As examples, we share your PHI with organizations that help us run and maintain the technology and security infrastructure that supports our Website and the care we provide. We also may share your health information with medical staff to ensure that we are providing a service that meets the appropriate standard of care. We share your PHI with the pharmacy if we give you a prescription and with intermediaries who enable us to send prescriptions electronically. If we order laboratory tests for you or if you “self order” laboratory testing, we share your PHI with the lab company that runs the tests. If a laboratory test we order for you finds a 'reportable' infection we may be required by law to share your PHI to your county health department.
We store information you provide us with whether you complete a visit or whether you do not complete a visit. We take the same precautions over your data regardless of whether you complete a visit.
We do not record video visits between our patients and our medical team.
We may use your Personally Identifiable Information (PII) or Protected Health Information (PHI) to tell you about health-related products and services.
We may share your Personally Identifiable Information (PII) or Protected Health Information (PHI) with a third party if we merge, are acquired or undergo an asset sale.
Our Site may contain links to other third-party sites. When you click on one of these links you are visiting a website operated by someone other than MyMenopauseRx, and the operator of that website may have different privacy policies. MyMenopauseRx is not responsible for the individual privacy practices of those websites. We encourage you to read and acknowledge the privacy policies of these third-party operators. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
Separate to the personal identifiable and health information we collect, we collect technical information about how you use our Site. We use this information to help us improve the overall quality of our Site, improve the service we provide, and improve our advertising and marketing campaigns. Technical information we collect and may be shared with Google, including information about your mobile device or computer, including but not limited to unique device identifiers and the operating system and browser you use, and information about when and how you use the MyMenopauseRx Website, including specific pages you visit, and information about your general location when you use the Website, including but not limited to your internet protocol address and MAC address. Google is not bound by the terms of this Privacy Policy as to how they use technical information about you but are instead bound by the Google Analytics, Terms of Use and Privacy Policies that are available on their respective websites.
We use 3rd party vendor remarketing tracking cookies, including Google Adwords and Facebook tracking cookies. This means we will continue to show ads to you across the internet. The third-party vendors will place cookies on web browsers in order to serve ads based on past visits to our website. Third party vendors, including Google and Facebook, use cookies to serve ads based on a user's prior visits to your website. This allows us to make special offers and continue to market our services to those who have shown interest in our service.
We do not respond to 'do not track' signals in your browser.
MyMenopauseRx does not sell, rent or lease its customer lists to third parties.
MyMenopauseRx may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. We are allowed to charge you a fee if we think it's appropriate, but we have made all your visit notes and any lab testing available for you to view on your patient dashboard free of charge. We are proud of the care we provide.
After obtaining and checking your health records, you may discover an error that has not been recorded. HIPAA gives you the right to make changes to your health information to correct mistakes. Any request to change your health record must be submitted in writing. We are unable to delete information from your medical record, but we can correct a mistake. In addition, at your request, we can de-activate your secure account so that you can no longer access it with your username/password.
You have a right to an accounting of disclosures of health data. If requested, we are required to provide information about who has received your health data. We follow the most current HIPAA guidelines. You are entitled to one disclosure accounting in a 12 month period at no charge. We will charge a fee for any additional accounting in a 12 month period. An accounting does not include disclosures to carry out treatment, healthcare operations or payment.
You have the right to restrict sharing of their health data for certain purposes other than treatment, payment, or healthcare operations. You can also dictate to whom their health information can be shared, such as family members, friends, caregivers, legal representatives, or other entities. They can also request that information is not shared with other individuals or groups. To restrict sharing of your health data, please submit your request in writing since MyMenopauseRx platform is only designed for a telehealth visit with the intended recipient.
If you believe your health data has been accessed by an unauthorized individual, has been impermissibly disclosed, or you believe that any aspect of HIPAA Rules has been violated, you have the right to file a complaint.
HIPAA does not have a private cause of action, which means that it is not possible for an individual to take legal action against a HIPAA-covered entity or business associate for a privacy breach or HIPAA Rule violation.
Due to the electronic nature of our service we are limited in our ability to agree to such requests, but feel free to print this page for your records.
